Spanish Supreme Court Challenges Amnesty Law

Published: 2024-07-11

The Spanish Supreme Court has initiated steps to challenge the constitutionality of the Amnesty Law for Catalan independence supporters.

The court argues that the law, which would pardon offenses related to the Catalan independence movement, may violate the principle of equality before the law.

Judges claim the legislation could be discriminatory, arbitrary, and potentially undermine legal security.

The court has given parties and the public prosecutor ten days to present arguments before potentially referring the matter to the Constitutional Court.

Despite these concerns, the Supreme Court has determined that public disorder and assault on authority charges related to protests following the 'procés' trial verdict are eligible for amnesty under the current law.
