Supreme Court Upholds Rainbow Flag Display

The Spanish Supreme Court has ruled that the rainbow flag, symbolizing the LGTBI community, can be displayed on public buildings during Pride celebrations.

This decision comes after the court rejected appeals from the Christian Lawyers Association, which argued that the flag's display violated laws governing the use of official symbols.

The court clarified that the rainbow flag is not a partisan symbol and does not incite conflict, but rather promotes equality, a value enshrined in both the Spanish Constitution and the EU Charter of Fundamental Rights.

This ruling resolves previous conflicting decisions from regional courts in Zaragoza and Valladolid, affirming that the 1981 law on official flags does not apply to the rainbow flag.

The decision underscores the court's stance that promoting equality aligns with the principles of objectivity and neutrality required of public administrations.
